This Privacy Policy explains how we collect, use, share, and protect information in connection with SmokeQuant, the platform we operate, including our website at smokequant.com, our application at app.smokequant.com, and any related services (collectively, the “Services”).

SalesQuant LLC is a California limited liability company. It operates SmokeQuant, a platform providing sales intelligence, compliance tracking, lead generation, and customer relationship management software for the alternative products distribution industry.

2. Information We Collect

2.1 Information You Provide

When you interact with the Services, we may collect:

• Account information: name, business name, email address, phone number, job title, and password
• Billing information: billing contact, billing address, and payment method details (processed by our payment processor; we do not store full card numbers)
• Communications: messages you send to us via email, support tickets, or demo requests
• Content you upload: customer relationship data, lead lists, notes, and files you import into the Services

2.2 Information We Collect Automatically

When you use the Services, we automatically collect:

• Usage data: pages visited, features used, actions taken, timestamps, and performance data
• Device and connection data: IP address, browser type and version, operating system, device type, and referring URLs
• Cookies and similar technologies: we use strictly necessary cookies for authentication and session management, and may use first-party analytics cookies to understand how the Services are used

2.3 Information We Collect from Third Parties

For our own sales and marketing purposes, we collect publicly available business contact information (names, business email addresses, business phone numbers, company names, and websites) from public sources including company websites, public directories, and published industry listings. We use this information to contact potential customers about SmokeQuant.

2.4 Compliance and Industry Data

The Services include compliance, regulatory, and industry news data that we compile from public government sources, regulatory filings, and published news. This data relates to businesses, products, and regulations—not to individual consumers.

3. How We Use Information

We use the information we collect to:

• Provide, operate, maintain, and improve the Services
• Authenticate users and secure accounts
• Process payments and manage subscriptions
• Send transactional emails (account notifications, billing receipts, service updates)
• Send marketing communications about SmokeQuant (you may opt out at any time)
• Respond to inquiries, support requests, and feedback
• Detect, prevent, and address fraud, abuse, and security issues
• Conduct analytics to understand and improve how the Services are used
• Comply with legal obligations and enforce our Terms of Service
• Conduct outbound sales and marketing outreach to prospective customers

4. How We Share Information

4.1 Service Providers

We use third-party service providers to operate the Services. These providers process data on our behalf and are contractually bound to protect it. Current service providers include:

• Render (cloud hosting and database infrastructure)
• Cloudflare (content delivery, DNS, and security)
• Brevo (transactional and marketing email delivery)
• Google Workspace (business email and productivity)
• Calendly (demo scheduling)
• Easy Pay Direct (payment processing; processes billing information and payment transactions)

4.2 Business Transfers

If SmokeQuant is involved in a merger, acquisition, financing, sale of assets, reorganization, or bankruptcy, information may be transferred as part of that transaction, subject to standard confidentiality protections.

4.3 Legal Requirements

We may disclose information when we believe in good faith that disclosure is required to comply with a law, regulation, subpoena, legal process, or government request, or to protect the rights, property, or safety of SmokeQuant, our users, or others.

We may share information with other parties when you direct us to or consent to the sharing.

4.5 What We Do Not Do

We do not sell personal information. We do not share personal information for cross-context behavioral advertising. We do not rent, trade, or otherwise monetize personal information for marketing purposes beyond our own direct outreach.

5. Customer Data (B2B Service Provider Role)

When you upload, import, or otherwise provide data about your own customers, prospects, or contacts into the Services (for example, importing a CSV of leads), you are the controller of that data and we process it on your behalf as a service provider. You are responsible for:

• Having the legal right to collect and provide that data to us
• Complying with applicable privacy laws regarding how you obtained and use that data
• Responding to requests from individuals whose data you uploaded

We will assist you in responding to such requests where reasonable and as required by law.

6. Data Retention

We retain information for as long as your account is active and as needed to provide the Services. After account cancellation, we retain data as follows:

• Active account data: retained while your account is active
• Canceled account data: retained for 30 days after cancellation, then deleted or anonymized, unless a longer period is required by law or for legitimate business purposes (such as fraud prevention or dispute resolution)
• Billing records: retained for 7 years to comply with tax and accounting obligations
• Anonymized/aggregated usage data: may be retained indefinitely for analytics
• Email suppression lists: retained indefinitely to honor opt-out requests

You may request earlier deletion as described in Section 9.

7. Data Security

We implement reasonable administrative, technical, and physical safeguards designed to protect information from unauthorized access, use, alteration, and disclosure. These include encryption in transit (TLS), access controls, authentication requirements, and regular security reviews.

No system is perfectly secure. We cannot guarantee the absolute security of information. If we become aware of a security incident that affects your information, we will notify you as required by applicable law.

8. United States Only

The Services are offered and intended solely for use by businesses and individuals located in the United States. We do not market or direct the Services to users outside the United States. Our infrastructure is located in the United States, and all information we collect is stored and processed in the United States.

If you are accessing the Services from outside the United States, you do so on your own initiative and are responsible for compliance with local laws. We may, at our discretion, decline to provide the Services to users outside the United States.

9. Your Privacy Rights

Depending on where you live, you may have the following rights:

• Access: request a copy of the personal information we hold about you
• Correction: request that we correct inaccurate information
• Deletion: request that we delete your information
• Portability: request your information in a portable format
• Opt-out of marketing: unsubscribe from marketing emails at any time using the link in the email or by contacting support@smokequant.com
• Opt-out of sale or sharing: although we do not sell or share personal information for cross-context behavioral advertising, you may submit a request at support@smokequant.com
• Non-discrimination: we will not discriminate against you for exercising your privacy rights

9.1 California Residents

If you are a California resident, the California Consumer Privacy Act (CCPA), as amended by the California Privacy Rights Act (CPRA), provides you with the rights described above. In the preceding 12 months we have collected the following categories of personal information: identifiers; commercial information; internet or other electronic network activity information; professional or employment-related information; and inferences drawn from the above. We have not sold personal information and have not shared personal information for cross-context behavioral advertising.

You have the right to designate an authorized agent to make requests on your behalf.

9.2 Other U.S. State Privacy Laws

Other U.S. states including Virginia, Colorado, Connecticut, Utah, Texas, Oregon, Montana, and others have enacted privacy laws that may provide rights similar to those described above. If you are a resident of one of these states, you may exercise applicable rights by contacting support@smokequant.com.

10. Children’s Privacy

The Services are intended for business users and are not directed to children under 16. We do not knowingly collect personal information from children. If we learn we have collected personal information from a child under 16, we will delete it.

11. Third-Party Links

The Services may contain links to third-party websites and services. This Privacy Policy does not apply to those third parties. We encourage you to review the privacy policies of any third-party sites you visit.

12. Changes to This Privacy Policy

We may update this Privacy Policy from time to time. If we make material changes, we will notify you by email or through the Services before the changes take effect. The “Last Updated” date at the top of this policy indicates when it was last revised. Continued use of the Services after changes take effect constitutes acceptance of the updated policy.
